1. Agreement to Terms
These Terms of Service ("Terms") govern your use of rutherfordmade.com, operated by RutherfordMade based in Woodstock, Georgia. By accessing the site or booking a consultation, you agree to these Terms. If you don't agree, don't use the site.
2. Services & Consultations
The website allows you to learn about our custom pool and outdoor living services, view our portfolio, and schedule a free design consultation. A consultation is an informational meeting — no contract is formed unless and until both parties sign a separate written project agreement.
3. Project Contracts
All construction work is governed by a separate written contract signed by you and RutherfordMade. That contract — not this website — defines scope, price, timeline, warranties, and payment terms. These Terms do not replace or modify your project contract.
4. Guarantees
The 12 written guarantees referenced on our site (including the lifetime structural warranty, 10-year leak-free guarantee, price lock, and satisfaction guarantees) are detailed in the project contract. Terms and conditions are provided in full before any project begins.
5. Financing
Financing is offered through our third-party partner Lyon Financial. Loan approval, terms, and conditions are determined by Lyon Financial, not RutherfordMade. We are not a lender.
6. Service Area
We serve Woodstock, Kennesaw, Marietta, Canton, Dallas, Sandy Plains, Allatoona, and surrounding North Metro Atlanta communities. We generally don't travel outside this area.
7. Intellectual Property
All content on this site — including photos, designs, text, logos, and videos — is the property of RutherfordMade or used with permission. Don't copy, reuse, or distribute without written permission.
8. Communications
By booking a consultation or submitting a form, you agree we may contact you by phone, email, and SMS about your inquiry or project. You can opt out of marketing communications at any time.
9. Disclaimers
The website is provided "as is" without warranties of any kind. Information on the site (project timelines, pricing estimates, financing terms) is illustrative — final specifics are in your signed project contract.
10. Limitation of Liability
To the maximum extent permitted by law, RutherfordMade is not liable for indirect, incidental, or consequential damages arising from your use of the website. Our liability for any claim related to this website is limited to the amount you paid us, if any, in the prior 12 months for services rendered.
11. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the site will be resolved in the state or federal courts located in Cherokee County, Georgia.
12. Changes
We may update these Terms. Material changes will be reflected in the "Last updated" date above. Continued use after changes constitutes acceptance.
